Tribunal: Strange Witness Claims Akpabio Was Shortchanged By 29,556 Votes

A witness who was not playing any role in the presidential and national assembly elections on February 23, 2019 in Akwa Ibom Northwest Senatorial district was subpoenaed to appear before the tribunal sitting in Uyo today at the instance of the Peoples’ Democratic Party, PDP, as Senator Godswill Akpabio is challenging the emergence of Senator Chris Ekpenyong as the lawmaker representing Akwa
Ibom Northwest Senatorial district.

In his witness statement (Exhibit R600) deposed before the tribunal, Dr. Anietie Akpan, a lecturer teaching Business management and statistics in the University of Uyo, who was called by the PDP (2nd Respondent) to analyze the election results of Essien Udim local government area, made claims that from 115 polling unit result sheets (INEC Form EC8As) made available to him, All Progressives Congress, APC, polled 35,797 while PDP scored the total of 9,873, adding that it is not possible for the APC to score the total of 61,329 as contained in paragraph 15 sub-section 27 of the petitioner’s statement filed at the tribunal.

During cross-examination under the petitioner’s lead counsel, S.I. Ameh, SAN, the university lecturer agreed that if 6,241 stated by the Independent National Electoral Commission, INEC, in row 14 of Exhibit P536 being the total number of votes scored by the APC in Essien Udim local government area is subtracted from 35,797 credited to APC in paragraph 16 of his witness statement, the remainder will stand at 29,556 votes, conceding to the assertion put forward to him by Ameh that INEC shortchanged APC by  29,556 votes.

While Dr. Anietie Akpan admitted that he is not a registered voter anywhere in Akwa Ibom Northwest senatorial district and he did not play any role either as a voter or an official in the elections held in that senatorial district on February 23, 2019, the petitioner’s counsel asked him if he was privileged to use wards result (INEC Form EC8Bs) in his analysis of the outcome of elections in Essien Udim, but the witness said he was only limited to EC8A series to arrive at his conclusions.

As gathered by our correspondent during his cross-examination, Akpan, on Monday 22nd July, 2019, had access to 115 Form EC8A series filed at the tribunal while entering the witness box the following day. He confessed before the three-man panel that he was left with less than one day to analyze 115 polling unit results.

Dr. Anietie Akpan could not read to the hearing of the tribunal from anywhere in his witness’s statement to prove to the petitioner’s counsel that Justice W.O. Akanbi-led three-man panel invited him to assist them because they could not handle statistical calculations.

While bringing to the notice of the tribunal that the petition was filed on 16th March, 2019, S.I. Ameh, SAN, further put forward to the subpoenaed witness that he was carrying out analysis on results sheets
on 22nd July, 2019, the time the petition was still pending in the court.
