A’Ibom Election Tribunal Dragged To Federal High Court

The Chairman and the registrar of the Akwa Ibom State Gubernatorial Elections Petitions Tribunal sitting in Uyo along with the Independent National Electoral Commission, INEC, the state Governor and the Peoples’ Democratic Party, PDP, have been dragged to the Federal High Court of Nigeria in Abuja.

Mr. Iboro Otu, a governorship candidate of the Abundant Nigeria Renewal Party, ANRP, in March 9 gubernatorial election filed a suit, No: FHC/ABJ/CS/652/2019, through his counsel, Faruk Khamagham Esq, seeking the relief of the court to direct INEC to conduct fresh election into the office of Governor of Akwa Ibom State within 30 days of the date of judgment of the Federal High Court.
The plaintiff declared that the gubernatorial election held in Akwa Ibom State on 9th March 2019 was marred by illegality and substantial irregularities and such result ought not to stand.
He also declared that the persistent refusal of his petition by the election tribunal constitutes a grave infringement of the Applicants rights to fair hearing as guaranteed under Sections 36(6) of the Constitution of the Federal Republic of Nigeria 1999 (As Amended).
Mr. Iboro Otu, in an affidavit sworn at the Federal High Court of the FCT on 11th June 2019 said he is dissatisfied with the results of the Akwa Ibom gubernatorial election declared on 11th March 2019 and consequently approached the Gubernatorial Electoral Tribunal Registry in Akwa Ibom State in the midnight of 30th March 2019 after confirmation by the registrar that the petition will be duly received at any hour of the said date.

But on reaching the registry, the ANRP candidate said the registrar made a U-turn with an excuse that the process would extend to another day.
“Upon arriving the Tribunal Registry in the midnight of 30th March the 5th Respondent  made a summersault  and declared that he will not receive any petition midnight of 30th March 2019. He stated categorically that he will not receive my petition, the reason being that it would take some minutes to process a remitta payment and obtain a receipt and that before accomplishing that, the time would have elapsed into the next day being 31st March 2019,” the affidavit reads.
